If you haven’t used your mark in business yet, but are willing to, you can file Intent to Use the application, and if approved, you will receive a Notice of Allowance. When you receive the Notice of Allowance, you have six months to prove that you are using your mark. If you are not able to use your trademark in the given time, then you can also sign for five to six months of extension. When filing a statement of use, USPTO will require a specimen to prove that the trademark is being used.
These are the compulsory requirements to file your statement of use application: • A $100 USPTO fee per class. • A specimen of the mark is required to show that it is being used in business. • The verification about the usage of your mark as asked in the application.
Apart from the fee of Filed Trademark, the Statement of Use filing fee of USPTO is $100.
Once the USPTO has issued you the Notice of Allowance, it gives you six months to prove that you are using your mark. You can further extend this deadline for five to six months. But if you cannot meet the last deadline, your application will be considered abandoned.
